ITAS TO ITAP CONVERSION

Good day everyone!
Could anyone advise me if im eligible for ITAP or I need to renew my ITAS.
I have been married to an Indonesian man for over 4 years but i was living in Canada while he is here in Indonesia. This year, I decided to relocate so i can live with my hubby . We did tried to apply for ITAP as I read in the Immigration law that, after two years of marriage you can apply for ITAP. Well mine is over 4 years! Unfortunately, I sent few Emails to the Head of Immigration in Jakarta who told me im eligible but the Local Office said im not eligible. It was back and forth , So we gave up, went a head and converted my VITAS to ITAS.
Now the question is, Do i have to renew my ITAS next or I am eligible to apply for ITAP? Jakarta is 6hrs away from where i live.

You are eligible to get ITAP after ITAS after 2 years of marriage, but you if you have concluded the marriage ceremony in Indonesia, the Immigration will require to submit either: a)the non-impediment letter that you got before marriage or b)the registration of marriage in your country or c) a document from your embassy stating that such registration is not required.

The marriage ceremony was performed in Indonesia 4 years ago and I have the Indonesia marriage certificate.
Do I still have to submit the Non-Impediment letter I gave the office before the marriage?Thanks

In my experience, if you have an Indonesian marriage certificate, any other marriage-related documents issued by other countries/embassies are no longer required. The non-impediment letter was submitted to the Civil Registry as one of the documents required to get the marriage certificate.

If you have a copy, yes. If not, you can substitute with the marriage registration in your own country, or a letter from the embassy stating that such registration is not required.

If you married legally in Indonesia, there is no difference. For everyone who married abroad and later registered their marriage in Indonesia, this detail can be extremely relevant.

As far as I know, to get an ITAP, you need an ITAS-spouse first and the next year you can apply for an ITAP.
As long as you are on spouse KITAS and the min. 2 years since (Indonesian registered) marriage passed, you can immediately apply for ITAP. No need to wait until the end of KITAS validity. You might want to benefit from the KITAS year you paid for, or depending on your travel plans etc. file for KITAP as fast as possible.

Do you know if i can travel overseas during the ITAP process? I understand the Department of Immigration will keep my passport until the ITAP is approved. Will they give it to me to travel to overseas for business
 
Indeed, your passport will remain with immigration, so travel will not be possible. I am not aware of any exemptions made, but think it is unlikely they will agree and I reckon it can jeopardize the whole process.

From the wedding date, the marriage has to be registered in Indonesia and recognized in the other spouse's country as well.
 
With a WNI KITAS, we applied for KITAP towards the end of that year. Apart from the usual paperwork there were no problems and we did not use an agent. With 5 years on KITAP recently applied for the "permanent" KITAP. About four visits to Imm offices but it all went smoothly. I have to report in after 5 years but no more paperwork or futher expenditure. Now I have to make sure I live more than 5 years to get my moneys worth.

I think you should get your facts straight, but it looks it is beyond your scope of understanding. Let me help you.

I personally know a foreigner married for more than 30 years in Austria to an Indonesian citizen. He registered the marriage last year in Indonesia and got KITAS and KITAP immediately after that, in a regular procedure. No "2 years from registration". Also, I know several similar cases like this. The marriage starts with the marriage ceremony, and it is just acknowledged in another spouse's country (you cannot be married for 2 years in one country and married for 1 year in another). Immigration regulations mention 2 years in marriage(not registration).

In international private law, marriage will have to be valid and in accordance with the law of each respective spouse. For that purpose, many (or some) countries require registration of the marriage, while some accept it straight away without formal registration.

In Indonesia, if married in Indonesia, you can prove that your Indonesian marriage is valid in your foreign spouse's country twofold-either you present the non-impediment letter, or you present the marriage registration in the foreign country. Alternatively, If the foreign country does not register foreign marriages, you can present a letter from the embassy stating that the country recognizes foreign marriages straight away (to immigration, for KITAS/KITAP process)-I know that Canada and the US embassies were issuing such letters.

The "reporting" is clearly without fees, but expect some paperwork, potentially up to as much as the previous extension.

And of course there are still fees for MERP/IMK if you ever wish to leave the country (and return).

Let me tell you what I encountered; not people who were married 30 years ago abroad and who lived there ever since and who came to retire in RI. (So like Fastpitch.) No, the spouses still had the KTP in Indonesia and officially lived here. Even if they did register the marriage at the CatSip when they returned, that particular registration date was taken later as ‘marriage date’. One was before the 30 day rule. There was another couple of which the WNI did not register at return, and they encountered major issues, the officials really made it difficult for them and it ended up in a law suit. But that’s a different matter.

There are practically no countries (US / EU / AU / etc.) that require marriage registration if the person lives abroad and it is often not even possible.
